Hmm. I'm almost inclined to say we should have a section in the HES Reference section devoted to items of interest from the Bayerische Staatsbibliothek's Digital Library--this is the third work of interest to this community I've seen from that site so far, and all of them high-quality digital reproductions.

They have a s*** load of stuff, I believe the material formerly in Augsburg is now there as well. (Does anyone know?) Wow using this is so much easier than my old microfilms.

Sorry this was poorly written, the BSB has in its collection many work, including the material formerly in the collection of the University of Augsberg. Hils provides this list, as does AEMMA, perhaps some 15 manuscripts.

Does anyone know if there are any limitations on the use of the material on these pages? I (with a little help from my friends) wrote a small program to grab the high resolution scans of each page in a book and save it to my computer. Have I broken any rules/laws by using this program? Can these scans be used freely for noncommercial purposes? How about commercial ones?

That issue has been discussed on other threads a fair bit.

Short answer:
No-one here can give you legal advice - your best option is to contact the museum and ask before you do anything with the images, either copying them or re-distributing them.

Long answer -
They dont own the images in the manuscript but they do own the images on the net. One is not the other. Non-commercial use should not be a legal issue as there are no damages incurred. The issue with that is the pottential loss of good will from the museum and withdrawl of the net images which is bad for everyone. Commercial use without permission will land you in court.

Hi Petter,

non-commercial use, or use at a class as reference, or to use them to help you in research, even if you would profit from the research should be all right, that is why the images are online anyway; it is the same as going to a museum to take photos of armor and use that for research, or like borrowing/studying any book in a library or studying art in a gallery.

However, if you talk about commercial use in the sense of reproducing the whole facsimile of a treatise for sale, that is not to be done. For use of some of the images with a published article, or webpage, should be all right given that you cite the source of the images, and for the benefit of the reader it is a good idea to provide a link for the whole experience.

I am not a lawyer or legal expert, but I believe these to be good rules of engagement. When doing any kind of published use of the images, it does not hurt to ask for permission from the owner/administrator of the collection where the scans are from. I am sure they will be happy to provide the images for that sort of use, especially when the collection is not private.

When I went to look at the Der Altenn Fechter anfengliche Kunst that Steven posted and saw that I could download it as a PDF. Before I could download it I was asked to agree to use it only for "private or academic purposes."
